New protection coming against your Home Owners Organisation
In terms of the Consumer Protection Act, which will become law in October, home owners' associations will be regarded as suppliers of services and home owners as their consumers can exercise their consumer rights against an HOA.
Karien Hunter of attorneys AMC Hunter said this meant the HOA would no longer be able to prescribe to home owners the appointment of contractors or agents allowed to work on an estate.
Thus the consumer has a right to choose whom they wish to associate with, and a supplier will infringe this right should they prescribe that the consumer may only deal with certain contractors or estate agents.
